Section 1

About CheckRada

CheckRada ("the Platform") is operated by Mavlon Enterprises Limited, a company registered in Kenya under the Companies Act 2015. CheckRada is Kenya's first incentivised forecasting and crowd intelligence platform. Users forecast the outcomes of real-world verifiable events and earn rewards based on accuracy.

By accessing or using CheckRada you agree to be bound by these Terms and Conditions. If you do not agree, you must not use the Platform.

Section 2

Eligibility

You must be 18 years of age or older to use CheckRada. By creating an account you confirm you meet this requirement. CheckRada is currently available to residents of Kenya only. We reserve the right to verify age and identity at any time and to suspend accounts where eligibility cannot be confirmed.

Section 3

Nature of the Platform

CheckRada is an information-based forecasting platform, not a wagering or games-of-chance service. Forecasts are made on verifiable real-world outcomes across categories including Politics, Economy, Weather, Entertainment, Technology, and General current affairs. CheckRada does not operate under any wagering licence.

Participation constitutes an incentivised data contribution, not a wager. The Platform generates crowd intelligence data as a commercial product independent of individual forecasting outcomes.

Prohibited Market Topics: CheckRada does not permit markets or forecasts concerning the death, injury, or physical harm of any named individual, nor markets predicting the occurrence, timing, or severity of natural disasters (including but not limited to earthquakes, floods, and famine). Proposed markets on these topics will be rejected during review. CheckRada reserves sole discretion to reject or remove any market it determines is inconsistent with this policy or otherwise inappropriate.
Section 4

Account Registration

You register using your Kenyan mobile phone number verified by a one-time password (OTP) delivered via WhatsApp. Your phone number is your identity on CheckRada. You are responsible for all activity on your account. You must not share your OTP or allow others to access your account. CheckRada is not liable for losses arising from unauthorised account access where you have shared your credentials.

Section 5

Deposits and Withdrawals

All transactions are conducted in Kenyan Shillings (KES) via M-Pesa, including M-Pesa STK Push and manual Paybill payment. The minimum deposit is KES 10 and the maximum single deposit is KES 70,000. The minimum withdrawal is KES 100 and the maximum single withdrawal is KES 70,000. Withdrawals are processed to your registered M-Pesa number, subject to Safaricom M-Pesa service availability. Deposits made via Paybill that cannot be automatically matched to your account may require manual review before your balance is updated.

CheckRada reserves the right to request identity verification before processing withdrawals above certain thresholds as required by applicable Kenyan law including the Proceeds of Crime and Anti-Money Laundering Act.

Section 6

Forecasting and Fees

CheckRada applies several fees and rewards as part of Platform operations, described below. All rates stated in this section are variable and may be changed by CheckRada from time to time. The rate applicable to any specific action is always displayed within the Platform before you confirm that action. Material changes to these rates will be communicated in accordance with Section 12 (Changes to Terms).

Forecasting Fee: A fee is applied to every position you take on a public market, regardless of outcome. This fee covers platform operations and market resolution costs.

Resolution Fee: When a public market resolves, a further fee is deducted from the losing side of the pool before winnings are distributed to accurate forecasters. This fee does not reduce the principal of any winning forecast.

Creator Royalty and Bounty: Users who create an approved public market may earn a royalty, credited automatically to their CheckRada wallet, based on trading activity on that market while it remains active. CheckRada may additionally offer bounty rewards for approved market suggestions or other creator contributions, at CheckRada's discretion.

Social Challenge Fees: A fee applies to Social Challenge outcomes resolved by mutual agreement or by a nominated Referee. Where a Social Challenge outcome is disputed and requires Platform intervention to resolve, a higher fee applies to the total pool to cover dispute resolution costs. The applicable rates are displayed within the Platform when you create or join a Social Challenge.
Section 7

Market Resolution

Public markets are resolved by the CheckRada Integrity Team based on official, publicly verifiable sources. In cases of conflicting reports, official government and regulatory data sources (e.g., KNBS, CBK, EPRA, Ministry publications) shall take precedence over media outlets. CheckRada's source selection and resolution decisions are final.

Social Challenges are resolved by a nominated Referee or by mutual agreement, with a 48-hour dispute window. If a market cannot be resolved due to postponement or ambiguity, all participation funds are refunded in full with no fees deducted.

Section 8

Bonus Balance

Referral bonuses and promotional credits are credited to your Bonus Balance. Bonus Balance must be used in a forecast before it can be withdrawn to M-Pesa. Bonus Balance cannot be transferred to another user. CheckRada reserves the right to modify or discontinue bonus programmes at any time with prior notice via WhatsApp.

Section 9

Prohibited Conduct

You must not create multiple accounts, manipulate markets, use automated tools to place forecasts, share misleading information about market outcomes, or attempt to exploit platform errors or vulnerabilities. You must not use CheckRada for money laundering or any activity prohibited under Kenyan law.

Violation of this section will result in immediate account suspension, forfeiture of balance, and where applicable, reporting to relevant Kenyan authorities.

Section 10

Intellectual Property

All platform content, design, software and the CheckRada brand are the intellectual property of Mavlon Enterprises Limited. The National Sentiment Index data generated by the Platform is proprietary to CheckRada. Institutional access to this data requires a separate Data API Agreement. Unauthorised reproduction or distribution of Platform data is prohibited.

Section 11

Limitation of Liability

CheckRada is provided on an "as is" basis. We do not guarantee uninterrupted service. CheckRada is not liable for losses arising from market resolution decisions, M-Pesa service interruptions, or events beyond our reasonable control.

Data Accuracy Disclaimer: All forecasts represent collective crowd sentiment and are not financial, investment or policy advice. The National Sentiment Index reflects aggregate user conviction, not guaranteed outcomes. CheckRada makes no representations as to the accuracy of crowd forecasts. CheckRada is not liable for any decisions made by any party based on Platform data, the National Sentiment Index, or any data accessed via the CheckRada Data API.
Section 12

Changes to Terms

We may update these Terms at any time. We will notify registered users via WhatsApp to their registered phone number at least 7 days before material changes take effect. Continued use of the Platform after the effective date of updated Terms constitutes acceptance.

Section 13

Governing Law

These Terms are governed by the laws of Kenya including the Consumer Protection Act, the Data Protection Act 2019, and the Proceeds of Crime and Anti-Money Laundering Act. Any disputes arising under these Terms shall be submitted to the exclusive jurisdiction of the Kenyan courts.

Section 14

Dormant Accounts

Accounts with a balance that have had no user-initiated activity for more than 24 consecutive months may be classified as dormant. CheckRada will attempt to contact the account holder via WhatsApp to their registered phone number at least 30 days before any dormancy classification. Users may reactivate dormant accounts by logging in and verifying their identity at any time.

Dormant account balances will be handled in accordance with the Unclaimed Financial Assets Act 2011 (Kenya) and the requirements of the Unclaimed Financial Assets Authority (UFAA).

Section 15

Force Majeure

CheckRada shall not be liable for failure to perform any obligation under these Terms where such failure results from circumstances beyond our reasonable control, including but not limited to: Safaricom M-Pesa service outages, government-ordered platform suspension, national infrastructure failure, Acts of God, civil unrest, or internet infrastructure failures beyond our network.

In such cases, all active participation balances shall be held securely in the Platform wallet and returned to users upon service restoration. CheckRada will communicate service interruptions via the Platform and where possible via WhatsApp.
